Court Dismisses Non-Borrower Claim in RESPA Case
A husband and wife took out a loan for a home. Both executed the mortgage, but only the husband executed the promissory note. The borrowers divorced, and the wife took title to the house. The husband later died and the wife fell behind in the mortgage. The home was foreclosed upon.
